PESTICIDE MANAGEMENT PLAN

COMPONENT 9. ENFORCEMENT

The State of Indiana has adequate authority under IC 13-7 (Environmental Management) and IC 15-3 (Horticulture Control) to develop and implement programs that will enforce requirements that will be identified in the State Management Plan (SMP). These requirements include the ability to collect pesticide occurrence data, and establish ground water quality standards.

In addition to the legal authorities identified above the Office of the Indiana State Chemist (OISC) has adopted a Civil Penalty schedule under 357 IAC 1-6 for violations of the Pesticide Registration Law; and, under 357 IAC 1-7 for violations of the Pesticide Use and Application Law (Appendix H.)

The enforcement roles and responsibilities for the IDEM Office of Water and the have been identified through Memorandum of Understanding (Appendix D.)
