Consultant Rule Requirements & Procedures
 
If you are selling pesticides (insecticides, weed killers, rodenticides, fungicides, etc.), and your employees provide advice to customers on the selection and use of pesticides, then you are subject to the Pesticide Consultants Registration Rule (357 IAC 1-9), which requires your store to be registered with the Office of Indiana State Chemist (OISC).
           
This rule applies to any retail establishment that:
1. Sells or offers for sale any pesticide; and
2. Has employees who provide pesticide selection and use advice to pesticide users (customers).
           
You are exempt from this rule if:
1. Your employees are not expected to and do not provide pesticide selection and use advice to customers; or
2. You are a physician, pharmacist, or veterinarian and the pesticide product is intended for use on humans or animals; or
3. Your establishment or one of your employees already has one of the following pesticide credentials issued by OISC:
  a. An Indiana pesticide business license;
  b. An Indiana restricted use pesticide dealer registration; or
  c. An Indiana pesticide applicator license.
           
What do you have to do if you are not exempted and this rule does apply to you?
1. Decide whether you want to continue providing pesticide selection and use advice. If you instruct your employees to provide no advice regarding pesticides, this rule does not apply to you. If you choose this approach, you are exempt from this rule. However, it is recommended that you:
  a. Formally notify current employees of your no-advice policy;
  b. Post a reminder about your policy on an employee bulletin board; and
  c. Include information about your policy in any of your new employee orientation programs.
2. If you choose to allow your employees to provide advice to customers, then you must do the following for each retail location:
  a. Complete and submit the application with a $45.00 check or money order made payable to the "Indiana State Chemist".
  b. Train all employees who provide pesticide selection and use advice. The training must cover the information listed on the Registered Pesticide Consultant Employee Training Criteria. You may use your own training program, or you may choose to contact Fred Whitford of the Purdue Extension Service at 765-494-1284 for assistance.
  c. Post a notice in an area that the employees will see reminding them that they must be trained before providing any pesticide selection and use advice. To view a sample notice, click here.
  d. Post a notice in a public area notifying your customers that they have the ultimate responsibility to read and follow the directions on the pesticide label and labeling. To view a sample notice, click here.
