| Recordkeeping
for Commercial Applicators |

This summary
and interpretive guidance relates to the Indiana recordkeeping regulation
(355 IAC 4-4) for use of restricted use pesticides
(RUP) by commercial applicators. It is suggested that both this
summary and the regulation be reviewed in their entirety for a full understanding
of
the recordkeeping requirements.

|
Records are to be
kept by all commercial applicators applying RUP's. This requirement
became effective in 1993. The specific records
to be kept are identified on the sample recordkeeping form which can be
viewed by clicking here. |

These records are
to be kept for at least two years. |
|
|
|
The final records
must be created within 30 days of the application. However, documentation
used to create the complete final records (i.e. spray tickets, invoices,
etc.) must be kept from the date of application until the final record
is completed. This is acceptable as long as all of the required informational
items are present and the private applicator can readily pull the information
together for each application. |

Records need not be kept on a special form, but use of one of the several
forms designed for this purpose is certainly acceptable. |

| Section 2: |
|
In addition to OISC, the records must upon request also be made available
to licensed health care professionals who are treating pesticide exposure
patients. |

| Inspection and Enforcement: |
|
OISC does not anticipate becoming involved in a large-scale records
inspection program. However, we will continue to inspect records as part
of our ongoing routine inspections and complaint follow-up investigations. |
|
|
|
Most recordkeeping violations will be handled at the state level with
enforcement ranging from warnings and citations to civil penalties (from
$0 to $100 per violation for private applicators). |
